Economic Development Company Contract Dispute Over Land Retrocession and Intersection Costs
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal concerning a dispute where an economic development company had organized planning meetings with a municipality regarding land use modifications for a development zone requested by a property company, and where the development contract allowed the company to demand retrocession or transfer of the land to an approved acquirer upon sale. The appellate court's decision was legally justified by finding that the property company had globally accepted responsibility for the costs of creating and modifying access intersections, thereby validating the lower court's ruling without needing to rely on an ancillary ground concerning the administrative court's stance on the legality of the required intersections.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur les trois moyens, réunis, ci-après annexés :
Attendu qu'ayant, d'une part, constaté que la société d'économie mixte d'aménagement du Val d'Oise (SEMAVO) avait organisé des réunions avec la municipalité d'Herblay pour parvenir à la modification des documents d'urbanisme afférents à la zone d'aménagement concertée demandée par la société foncière des copistes et présenté des projets de logement, notamment au cours des contacts directs entre cette société et la commune et relevé qu'aux termes de l'article 7 du cahier des charges applicables, la SEMAVO pourrait exiger, en cas de vente des terrains, que ceux-ci lui soient rétrocédés ou cédés à un acquéreur par elle agréée, et d'autre part, retenu que la société foncière des copistes avait accepté "globalement" de prendre en charge les frais de création et de modification des carrefours, la cour d'appel a, par ces seuls motifs, abstraction faite d'un motif surabondant relatif à l'absence de décision de la juridiction administrative sur le caractère illicite des carrefours exigés, légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne, ensemble, M. X..., ès qualités et la société Foncière des Copistes aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de la société Semavo ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du vingt-huit mars deux mille six.
