Neighbor Property Enclosure Upheld Against Claim of Insufficient Commercial Access
Synthèse Legislator
Généré par l'IAAn individual appealed a decision that allowed neighbors to enclose their property and install a gate, asserting that the access to their own property was insufficient for their commercial operations, specifically regarding deliveries. The court of appeal upheld the neighbors' right to enclose their land because the appellant failed to prove that deliveries (beer or potatoes) could not be executed from the street adjacent to the property, failed to provide evidence of an alleged storage facility requiring rear access, and did not establish that the customary parking of vehicles at the rear of the residence was an absolute necessity for business, thus the appellant did not demonstrate that the direct access to the public road was insufficient for the commercial exploitation of the property.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant relevé que M. X... ne contestait pas que les clients pouvaient stationner leurs véhicules sur la place aménagée de l'autre côté de la rue, qu'il ne produisait aucune pièce relative à l'existence d'un entrepôt de pommes de terre en fond du terrain arrière ou relative à la pratique de ses fournisseurs, qu'il n'établissait pas que la livraison de la bière ou des pommes de terre ne puisse s'effectuer à partir de la rue de Grévaux et que s'il avait pris l'habitude de garer ses véhicules à l'arrière de son habitation, il ne démontrait pas le caractère impératif de cet usage, la cour d'appel a retenu souverainement que le caractère insuffisant de l'accès direct de son fonds à la voie publique pour l'exploitation commerciale de sa propriété n'était pas établi et que les époux Y... devaient être autorisés à clôturer leurs parcelles et à implanter une grille à l'entrée de leur chemin ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne M. X... à payer aux époux Y... la somme de 2 000 euros ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du dix janvier deux mille six.
