Loan Repayment Action Upheld Despite Lack of Written Agreement
Synthèse Legislator
Généré par l'IAA party sued her former partner for the repayment of funds, given in cash and by check, totaling a specific sum during their cohabitation, asserting the transfer constituted a loan despite the absence of any written agreement. The appellate court upheld the claim, finding that the claimant established a "moral impossibility" of obtaining a written document, thereby negating the requirement for a written commencement of proof, and further concluded that the concurrent transfer of funds and the partner's acquisition of a business solely in his name sufficiently proved the existence of the alleged loan. The highest court ultimately rejected the appeal, confirming the lower court's factual findings regarding the loan's existence.

Attendu que Mme X... a remis une somme de 18 293 euros à M. Y..., à l'époque son concubin, partie au moyen d'un chèque bancaire, partie en espèces ; qu'aucun écrit n'a été établi entre les parties et qu'à la suite de la séparation du couple, Mme X... a assigné M. Y... en remboursement de cette somme outre intérêts, invoquant l'existence d'un prêt ;
Attendu, d'abord, que la cour d'appel ayant constaté l'impossibilité morale pour Mme X... de se procurer un écrit, aucun commencement de preuve par écrit ne s'avérait nécessaire ; qu'ensuite les juges du fond ont souverainement déduit de l'ensemble de leurs constatations que la remise de fonds par Mme X... à M. Y... concomitamment à l'acquisition par celui-ci d'un fonds de commerce à son seul nom suffisait à établir l'existence du prêt allégué ; qu'inopérant en sa première branche, le moyen ne peut être accueilli en sa seconde ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. Y... aux dépens ;
Vu les articles 700 du nouveau Code de procédure civile, 37 et 75 de la loi du 10 juillet 1991 rejette les demandes ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du treize décembre deux mille cinq.
