Court of Cassation Lacks Jurisdiction Due to Improper Appeal Filing
Synthèse Legislator
Généré par l'IAThe Court of Cassation found that it lacked jurisdiction to rule on an appeal concerning the inadmissibility of a debt relief application, because the appellant had filed her appeal incorrectly with the trial court's registry via registered mail, when the applicable law at the time required the appeal to be filed either by written declaration or by a mandated representative delivered or sent via registered mail directly to the registry of the Court of Cassation. The Court determined that the notification of the contested decision was invalid as it erroneously stated that the appeal could be filed orally or in writing with the trial court's registry, which meant the Court of Cassation was not properly seized of the matter.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu que le juge de l'exécution du tribunal d'instance de Pithiviers, statuant en matière de surendettement, ayant, par ordonnance du 25 novembre 2004, déclaré irrecevable la demande de Mme X... tendant au traitement de sa situation de surendettement, celle-ci s'est pourvue en cassation par lettre recommandée avec demande d'avis de réception adressée au greffe de cette juridiction ;
Attendu que, en cette matière et en l'état des textes alors applicables, le pourvoi en cassation devait être formé par déclaration écrite que la partie ou tout mandataire muni d'un pouvoir spécial remettait ou adressait par lettre recommandée avec demande d'avis de réception au greffe de la Cour de cassation ;
Attendu, cependant, qu'il résulte du dossier de la procédure que l'acte de notification du jugement attaqué mentionnait par erreur qu'un pourvoi en cassation pouvait être formé par déclaration orale ou écrite, remise ou adressée par pli recommandé au greffe du tribunal d'instance ; que compte tenu de cette notification dépourvue d'effet, la Cour de cassation n'a pas été saisie ;
PAR CES MOTIFS :
DIT n'y avoir lieu à statuer ;
Laisse les dépens à la charge du Trésor public
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du six avril deux mille six.
