AU NOM DU PEUPLE FRANCAIS

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :

Attendu que, par acte déposé au greffe de la Cour de cassation le 6 août 2004, Me Jacoupy, avocat à cette cour, a déclaré au nom de M. Guy X... Y... se désister purement et simplement du pourvoi formé par lui contre une décision rendue par la cour d'appel de Grenoble le 21 novembre 2001 au profit de Mme Marie-José Z... et MM. Cédric et Sébastien X... Y... ;

Mais attendu que ce désistement est intervenu après le dépôt du rapport ; que, dès lors, aux termes de l'article 1026 du nouveau Code de procédure civile, le désistement doit être constaté par arrêt ;

PAR CES MOTIFS :

Donne acte à M. Guy X... Y... de son désistement de pourvoi ;

Condamne M. Guy X... Y... aux dépens ;

Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du onze janvier deux mille cinq.
