Appeal Regarding Holographic Will Validity and Testamentary Capacity
Synthèse Legislator
Généré par l'IAThe case involved an appeal challenging the validity of a holographic will executed by an individual who named a specific person as the beneficiary of certain insurance contracts, with the appellant alleging the testator lacked the requisite mental capacity at the time the will was made. The Court of Cassation upheld the lower court's decision, reasoning that the appellate court, acting within its sovereign power to assess facts, was justified in finding that the appellant failed to prove the testator's insanity at the time of the disposition, and further, that the lower court was not obligated to investigate an aspect of the testament's formality that the appellant had failed to raise in their appeal arguments.

Attendu que Mme X... fait grief à l'arrêt attaqué (Grenoble, 14 octobre 2003), d'avoir déclaré valable le testament olographe rédigé le 18 juillet 1996 par M. André Y..., instituant Mme Z..., bénéficiaire des contrats Unofi souscrits le même jour ;
Attendu, d'une part, que c'est dans l'exercice de son pouvoir souverain d'appréciation des faits et des éléments de preuve versés aux débats, que la cour d'appel, qui n'était pas tenue de s'expliquer sur les autres éléments qu'elle décidait d'écarter et qui a recherché dans quel état psychique se trouvait le disposant avant et après l'acte incriminé, a estimé, par une décision motivée, que Mme X... ne rapportait pas la preuve, qui lui incombait, de l'insanité d'esprit du disposant à l'époque où la libéralité a été faite ; d'autre part, que faute par Mme X... de se prévaloir, dans ses conclusions d'appel, des dispositions de l'article 503 du Code civil, il n'appartenait pas à la cour d'appel de procéder à la recherche qu'il lui est reproché d'avoir omise ; que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne Mme X... à payer à Mme Z... la somme de 1 000 euros ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du dix-huit mai deux mille cinq.
