Appeal Inadmissibility Based on Principal Claim Does Not Preclude Examination of Subsidiary Claims
Synthèse Legislator
Généré par l'IAA litigant, declared in judicial liquidation, appealed a lower court judgment that set the date of cessation of payments, raising the primary claim that the judgment should be declared void under a specific procedural article, and subsidiarily challenging the date itself. The appellate court rejected the appeal as inadmissible, holding that the primary request did not fit the scope of applicable appeal procedures and therefore precluded examination of the subsidiary requests. The high court quashed this decision, reasoning that since the appellate court was properly seized of requests seeking the annulment or reform of the judgment, even if presented subsidiarily, the inadmissibility of the principal claim did not nullify the admissibility of the subsidiary claims, which the court was obligated to examine.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Vu l'arrêt n° 389 F-D rendu le 10 mars 2004 par la Deuxième chambre civile de la Cour de Cassation ;
Donne acte à M. X... de sa reprise d'instance de cassation contre M. Vincent Y..., ès qualités, désigné comme mandataire liquidateur par jugement du 20 mai 2003 ;
Sur le moyen unique pris en ses deuxième et troisième branches :
Vu les articles 4, 5 et 542 du nouveau Code de procédure civile ;
Attendu que l'appel tend à faire réformer ou annuler par la cour d'appel un jugement rendu par une juridiction du premier degré, et que le juge doit se prononcer sur tout ce qui est demandé ;
Attendu, selon l'arrêt attaqué, que, déclaré en liquidation judiciaire, M. X... a interjeté appel d'un jugement reportant la date de cessation des paiements, rendu sur requête de son liquidateur ; que l'appelant a demandé à la cour d'appel de prononcer la caducité du jugement déféré sur le fondement de l'article 478 du nouveau Code de procédure civile, subsidiairement d'en prononcer la nullité et plus subsidiairement de dire que l'état de cessation des paiements n'était pas établi à la date du report ;
Attendu que pour déclarer l'appel irrecevable, l'arrêt retient que la demande tendant à voir déclarer non avenu le jugement n'entre pas dans les prévisions de l'article 542 du nouveau Code de procédure civile et que les demandes subsidiaires ne peuvent pas être examinées ;
Qu'en statuant ainsi, alors qu'elle était régulièrement saisie, fût-ce à titre subsidiaire, de demandes tendant à faire annuler ou réformer le jugement et que l'irrecevabilité de la demande principale n'affectait pas la recevabilité des demandes subsidiaires sur lesquelles elle devait statuer, la cour d'appel a violé les textes susvisés ;
PAR CES MOTIFS et sans qu'il y ait lieu de statuer sur la première branche du moyen :
CASSE ET ANNULE, dans toutes ses dispositions, l'arrêt rendu le 19 mars 2002, entre les parties, par la cour d'appel de Montpellier ; remet, en conséquence, la cause et les parties dans l'état où elles se trouvaient avant ledit arrêt et, pour être fait droit, les renvoie devant la cour d'appel de Montpellier autrement composée ;
Condamne M. Y..., ès qualités, aux dépens ;
Dit que sur les diligences du Procureur général près la Cour de Cassation, le présent arrêt sera transmis pour être transcrit en marge ou à la suite de l'arrêt cassé ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du six janvier deux mille cinq.
