Agent Commission Dispute on Business Introduction Sufficiency
Synthèse Legislator
Généré par l'IAThe reviewing court upheld the lower court's decision to reject a claim for commission by an agent who argued that providing notice in February 1996 about an imminent tender from a hospital and the associated award conditions satisfied her contractual obligation as a business introducer. The reviewing court found that the lower court properly considered the scope of the agency agreement and did not improperly shift the burden of proof to the claimant, concluding that the information provided by the agent did not establish that she had successfully introduced the specific business for which she sought payment.

Attendu que c'est sans méconnaître l'étendue de la convention liant Mme de X... à la société IPODEC, en qualité d'apporteur d'affaires, et sans inverser la charge, incombant à la demanderesse, de prouver l'obligation dont elle demandait l'exécution, que l'arrêt attaqué (Paris, 23 novembre 2001) retient que l'information, donnée au mois de février 1996 par Mme de X... à sa co-contractante, de l'imminence d'un appel d'offre émanant de l'hôpital Begin, comme les conditions d'attribution du marché ne justifiaient pas que Mme de X... avait apporté à la société IPODEC l'affaire pour laquelle elle lui demandait le versement d'une commission ; qu'en aucune de ses branches le moyen n'est fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme de X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du douze avril deux mille cinq.
