AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que, par acte déposé au greffe de la Cour de Cassation le 7 décembre 2004, Me Blanc, avocat à la Cour de Cassation, a déclaré, au nom de Mme X..., se désister du pourvoi formé par elle, contre un arrêt rendu le 28 mai 2003, par la cour d'appel de Paris, au profit de M. De Y... ;
Que ce désistement, intervenu après le dépôt du rapport, doit, aux termes de l'article 1026 du nouveau Code de procédure civile, être constaté par arrêt ;
PAR CES MOTIFS :
DONNE acte à Mme X... du désistement de son pourvoi ;
Condamne Mme X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne Mme X... à payer à M. De Y... la somme de 2 000 euros ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du vingt-deux mars deux mille cinq.
