Appeal Inadmissibility for Interlocutory Judgment on Procedural Matters
Synthèse Legislator
Généré par l'IAThe appellants sought to appeal to the Court of Cassation against an interlocutory judgment from the Court of Appeal of Versailles, which had corrected a material error in a prior decision, declared the public prosecutor's appeal admissible, and ordered the appellants to submit their substantive arguments, without finally resolving the merits of the case. The Court of Cassation declared the appeal inadmissible based on articles 607 and 608 of the New Code of Civil Procedure, reasoning that judgments which only rule on procedural objections, pleas of inadmissibility, or other incidents without terminating the proceedings are not subject to appeal to the Court of Cassation independently, unless specifically provided for by law, which was not the case here.

Vu les articles 607 et 608 du nouveau Code de procédure civile ;
Attendu que les jugements en dernier ressort, qui se bornent à statuer sur une exception de procédure, une fin de non-recevoir ou tout autre incident, sans mettre fin à l'instance, ne peuvent être frappés de pourvoi en cassation indépendamment du jugement sur le fond que dans les cas spécifiés par la loi ;
Attendu que Mme X..., veuve Y..., Mme Y..., épouse Z... de A... et Mlles Stéphanie, Sophie et Elisabeth Y... ont formé un pourvoi en cassation contre un arrêt avant dire droit rendu le 18 octobre 2001 par la cour d'appel de Versailles, qui, après avoir rectifié l'erreur matérielle d'un précédent arrêt, a déclaré l'appel du ministère public recevable et a fait à nouveau injonction aux consorts Y... de conclure au fond ;
Qu'en l'absence de dispositions spéciales de la loi, ce pourvoi, dirigé contre un arrêt qui n'a pas statué au fond et n'a pas mis fin à l'instance, n'est pas recevable ;
PAR CES MOTIFS :
DECLARE le pourvoi IRRECEVABLE ;
Condamne les consorts Y... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du vingt-quatre juin deux mille quatre.
