The party seeking review improperly lodged their appeal by filing the declaration with the registry of the court of first instance, rather than through a declaration signed by an attorney licensed to practice before the Court of Cassation at its registry, as required for cases not specifically exempted by law from mandatory representation by such specialized counsel. Consequently, the Court declared the appeal inadmissible based on the procedural requirements of the relevant articles of the New Code of Civil Procedure.

AU NOM DU PEUPLE FRANCAIS

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :

Sur la recevabilité du pourvoi, contestée par la défense :

Vu les articles 973, 974 et 975 du nouveau Code de procédure civile ;

Atendu que, sauf disposition contraire, le pourvoi en cassation doit être formé par une déclaration faite au greffe de la Cour de cassation et signé par un avocat au Conseil d'Etat et à la Cour de cassation ;

Attendu que, par déclaration au greffe du tribunal d'instance d'Arras, M. X... a déclaré se pourvoir en cassation contre le jugement de ce tribunal rendu le 13 juin 2003 (RG n° 11-0003000) le condamnant à payer à la société Cofidis une certaine somme au titre d'un contrat de prêt ;

Attendu que, s'agissant d'une affaire où les parties ne sont pas dispensées par la loi de constituer un avocat au Conseil d'Etat et à la Cour de cassation, le pourvoi n'a pas été régulièrement formé ;

PAR CES MOTIFS :

DECLARE le pourvoi irrecevable ;

Condamne M. X... aux dépens ;

Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du onze janvier deux mille cinq.
