Construction Contract Termination and Key Restitution Dispute
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal concerning a construction contract where the client unilaterally terminated the agreement due to severe construction failures, including improvisation and numerous defects, thereby affirming the lower court's finding that the contractor was responsible for the contract's termination. Furthermore, the court upheld the finding that the contractor failed to prove the restitution of two sets of keys belonging to the clients, which was based on facts established by the lower court without improperly shifting the burden of proof.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le premier moyen ci-après annexé :
Attendu qu'ayant relevé que la société Entreprise de construction et de réhabilitation (ECR) avait gravement failli à ses obligations de constructeur, les travaux ayant été menés dans un état de complète improvisation, sans plan d'exécution, et étant affectés de nombreuses et graves malfaçons, la cour d'appel a pu retenir que la résiliation du contrat, unilatéralement notifiée par les époux X... plus d'un mois avant la date d'achèvement prévue, était en réalité imputable à la société ECR ;
D'où il suit que le moyen n'est pas fondé ;
Sur le second moyen, ci-après annexé :
Attendu qu'ayant constaté, par motifs propres et adoptés, que la société ECR avait en sa possession deux trousseaux de clés appartenant aux époux X..., la cour d'appel a pu retenir, sans inverser la charge de la preuve, qu'elle ne justifiait pas les avoir restitués ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société ECR entreprise de construction et de réhabilitation aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne la société ECR entreprise de construction et de réhabilitation à payer aux époux X... la somme de 2 000 euros et rejette la demande de la société ECR entreprise de construction et de réhabilitation ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé à l'audience publique du douze avril deux mille cinq par M. Villien, conseiller doyen, conformément à l'article 452 du nouveau Code de procédure civile.
