LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Attendu que M. X..., engagé en qualité de VRP selon contrat à durée indéterminée du 5 novembre 1998 par la société National Chemsearch, s'est trouvé en arrêt de travail pour maladie à compter du 17 avril 2000 ; que licencié le 2 mars 2001 au motif de la nécessité de procéder à son remplacement définitif, il a saisi la juridiction prud'homale ;
Sur le second moyen :
Attendu qu'il n'y a pas lieu de statuer sur ce moyen qui ne serait pas de nature à permettre l'admission du pourvoi ;
Et sur le premier moyen :
Attendu que le moyen ne peut être accueilli dès lors que la cour d'appel a retenu que la lettre ne laissait aucun doute sur la convocation du salarié à un entretien préalable au licenciement ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Chambre sociale, et prononcé par le président en son audience publique du quinze mars deux mille cinq.
