Insurance Indemnity Claim and Conservatory Attachment Dispute
Synthèse Legislator
Généré par l'IAAn insurer, having placed a conservatory attachment on funds it owed to an individual, was sued by that individual and their spouse to obtain an insurance indemnity payment, while the insurer simultaneously sought an enforcement order against the individual in a separate proceeding which resulted in a stay of judgment pending a final decision on a criminal complaint filed by the insurer. The Court of Cassation upheld the decision awarding the indemnity, reasoning that the conservatory attachment did not prevent the insured parties from obtaining a judgment establishing their claim against the insurer, as the insurer did not dispute the principle or amount of that claim, and that the lower court correctly exercised its discretion by ruling on the merits rather than granting a further stay.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, tel que reproduit en annexe :
Attendu, selon l'arrêt confirmatif attaqué (Versailles, 17 juin 2003), qu'après avoir pratiqué une saisie conservatoire entre ses propres mains sur toutes sommes qu'elle pourrait devoir, à quelque titre que ce soit, à M. X..., la société Abeille assurances, aux droits de laquelle vient la société Aviva assurances (la société), a assigné M. X... devant un tribunal de grande instance pour obtenir un titre exécutoire à son encontre ; que le tribunal a ordonné un sursis à statuer dans l'attente d'une décision définitive à intervenir sur la plainte avec constitution de partie civile déposée par la société à l'encontre de M. X... ;
qu'entre-temps, M. et Mme X... ont assigné la société devant un tribunal d'instance en paiement d'une indemnité d'assurance ;
Attendu que la société fait grief à l'arrêt d'avoir accueilli cette demande ;
Mais attendu que l'arrêt relève que la société ne conteste ni le principe ni le montant de la créance réclamée ; qu'il retient exactement, par motifs adoptés du premier juge, que la saisie conservatoire ne fait pas obstacle à l'obtention par M. et Mme X... d'un titre consacrant leur créance ; que par ces seuls motifs, la cour d'appel, qui n'a fait qu'user de son pouvoir discrétionnaire en ne répondant pas aux conclusions tendant au sursis à statuer et qui a répondu aux autres conclusions prétendument délaissées, a légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la compagnie Aviva assurances aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du dix février deux mille cinq.
