Supreme Court Decision Rectification for Material Error
Synthèse Legislator
Généré par l'IAThe Supreme Court, in its Commercial, Financial, and Economic Chamber, acting upon Article 462 of the New Code of Civil Procedure, reviewed its own decision from January 4, 2005, which had dismissed an appeal against a Rouen Court of Appeal ruling. The Court determined that a material error had occurred in the drafting of that prior ruling, specifically that the final word of the reasoning section should read "inopposable" (not opposable), and therefore, pursuant to its authority, it issued this subsequent decision to rectify that single word in the record of the original decision.
