Landowner v. Unauthorized Builder: Demolition of Construction
Synthèse Legislator
Généré par l'IAThe owner of the land sought the demolition of a construction erected by another party who could not provide any title for occupying the property. The Court of Cassation upheld the Court of Appeal's decision, affirming that since the builder failed to justify ownership, the lower court correctly inferred a lack of good faith, thereby rightly requiring the builder in bad faith to remove the construction at their own expense, without improperly shifting the burden of proof.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant constaté que M. X... ne justifiait d'aucun titre de propriété pour occuper le terrain, la cour d'appel, qui en a déduit, à bon droit, sans inverser la charge de la preuve, qu'il n'avait pas construit de bonne foi, a exactement retenu que les ayants droit de M. Y... étaient en droit d'exiger du constructeur de mauvaise foi la suppression à ses frais de la construction ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne M. X... à payer à Mme Z..., Mme A... et Mme B..., ensemble, la somme de 2 000 euros ;
