Construction Contract Cost Dispute Liability Appeal Rejection
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal regarding a construction contract dispute where the appellant, a construction company director and thus a professional who should have known modifications would increase costs, had already paid most of the disputed invoice. The appellate court's decision to hold the appellant liable was deemed legally sound because, despite including a superfluous reason concerning the project manager's duty to advise, the core finding relied on the appellant's professional status and substantial payment, justifying the ruling.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant constaté que M. X..., dirigeant d'une entreprise du bâtiment était un professionnel de la construction qui ne pouvait ignorer que la modification du projet se traduirait par un surcoût et qu'il avait d'ailleurs réglé la quasi-totalité de la facture litigieuse, la cour d'appel a, abstraction faite d'un motif erroné mais surabondant relatif à l'obliglation de conseil du maître d'oeuvre, légalement justifié sa décision;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé à l'audience publique du douze avril deux mille cinq, par M. Villien, conseiller doyen, conformément à l'article 452 du nouveau Code de procédure civile.
