Appeal Regarding Partnership in Fact and Tenancy Dispute
Synthèse Legislator
Généré par l'IAThe appellant, asserting he was not liable for the claimed sums, argued that the lower court erred in not investigating the existence of a partnership in fact and in finding that he was the undisputed tenant of the disputed land, merely contesting the lack of a demand or agreed amount for rent. The Court of Cassation rejected the appeal, reasoning that the appellate court was not obligated to conduct an inquiry that was not requested regarding a loan for use, correctly determined that no partnership in fact was demonstrated, and accurately concluded from the evidence and the appellant's own submissions that the appellant admitted his status as the tenant but only contested the basis for the demanded payment amounts.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le premier moyen, ci-après annexé :
Attendu que la cour d'appel, qui n'était pas tenue de procéder à une recherche qui n'était pas demandée sur l'existence d'un prêt à usage, a, sans dénaturation, retenu que la prétendue société de fait n'était nullement démontrée, qu'il ressortait des pièces versées aux débats et des propres écritures que M. Michel X... ne contestait pas sa qualité de preneur des terres objet du litige et ne faisait que s'opposer au paiement des sommes réclamées sur le fait qu'aucune demande de fermage n'avait été effectuée et qu'aucun montant de fermage n'avait été convenu ;
D'où il suit que le moyen n'est pas fondé ;
Et attendu qu'il n'y a pas lieu de statuer sur les autres moyens dont aucun ne serait de nature à permettre l'admission du pourvoi ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. Michel X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande des époux Guy X... ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du cinq avril deux mille cinq.
