Appeal Inadmissibility Due to Missing Signature
Synthèse Legislator
Généré par l'IAThe appellant challenged a decision by the Court of Appeal declaring his appeal against a judgment from the industrial tribunal inadmissible, citing violations of procedural rules concerning the appeal declaration. The Court of Cassation rejected the appeal, reasoning that the signature of the appellant, which serves to identify them and is a condition for the very existence of the appeal declaration, was absent from the document; therefore, the appellate court was justified in declaring the appeal inadmissible due to this fundamental irregularity equivalent to the absence of an act, without needing to investigate any potential grievance.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Sur les moyens réunis :
Attendu que pour des motifs pris de la violation des articles 114,117, 932, et 933 du nouveau Code de procédure civile, M. X... fait grief à l'arrêt attaqué (Montpellier, 26 juin 2002) d'avoir déclaré irrecevable son appel à l'encontre d'un jugement rendu par le conseil de prud'hommes dans une instance qui l'oppose à son employeur l'association Fédération nationale Léo Lagrange ;
Mais attendu que la signature de l'appelant, qui l'identifie, constituant une condition d'existence de la déclaration d'appel, c'est à juste titre que la cour d'appel, après avoir constaté que la déclaration ne portait pas de signature, a déclaré l'appel irrecevable, sans avoir à rechercher l'existence d'un grief dès lors que l'irrégularité constatée équivalait à une absence d'acte ; que les moyens ne sont pas fondés ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Chambre sociale, et prononcé par le président en son audience publique du neuf mars deux mille cinq.
