Liquidator's Appeal on Factual Assessment of Dismissal Upheld by Supreme Court
Synthèse Legislator
Généré par l'IAThe appellant, acting as the judicial representative liquidator of a company, challenged a lower court's decision, arguing against the factual assessment regarding the real and serious nature of a dismissal, but the Supreme Court found that the two grounds of appeal merely sought to question the discretion of the lower court judges under the relevant labor code provision concerning dismissal validity. Consequently, the Supreme Court upheld the Court of Appeal's decision, finding it legally justified and without misinterpretation of the facts, and dismissed the appeal, ordering the liquidator to pay legal costs and an indemnity to the opposing party.

LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Donne acte à M. X... de ce qu'il reprend l'instance en qualité de mandataire judiciaire, ès qualités de liquidateur de la société Trade international company ;
Sur les deux moyens, réunis :
Attendu que ces moyens ne tendent qu'à remettre en cause le pouvoir d'appréciation que les juges du fond tiennent de l'article L. 122-14-3 du Code du travail quant au caractère réel et sérieux d'un licenciement ; qu'ainsi, la cour d'appel (Aix-en-provence, 27 février 2003) a, sans dénaturation, légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X..., ès qualités, aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne M. X..., ès qualités, à payer à M. Y... la somme de 1 500 euros ;
Ainsi fait et jugé par la Cour de Cassation, Chambre sociale, et prononcé par le président en son audience publique du trente mars deux mille cinq.
