AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que, par acte déposé au greffe de la Cour de Cassation le 5 novembre 2004, la SCP Célice, Blancpain et Soltner, avocat à cette Cour, a déclaré, au nom de la Société européenne de développement du financement, se désister purement et simplement du pourvoi formé par elle contre une décision rendue par le tribunal d'instance de Bourges le 6 janvier 2003 au profit de M. X... ;
Mais attendu que ce désistement est intervenu après le dépôt du rapport ; que dès lors, aux termes de l'article 1026 du nouveau Code de procédure civile, le désistement doit être constaté par arrêt ;
PAR CES MOTIFS :
DONNE ACTE à la Société européenne de développement du financement de son DESISTEMENT de pourvoi ;
Condamne la Société européenne de développement du financement aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du quatre janvier deux mille cinq.
