Appellant v. Respondent on Untimely Final Submissions
Synthèse Legislator
Généré par l'IAThe appellant challenged a ruling that rejected their final submissions as untimely, filed on February 5, 2003, despite being notified of the procedural schedule on October 31, 2002, and submitting the documents just one day before the closure order, which prejudiced the opposing party's right to reply. The high court upheld the appellate decision, reasoning that the late filing, which prevented the respondent from adequately responding, constituted a violation of the principle of fairness in proceedings, thereby legally justifying the rejection of those conclusions.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, tel que reproduit en annexe :
Attendu que M. X... fait grief à l'arrêt attaqué (Paris, 24 avril 2003), d'avoir rejeté des débats comme tardives ses conclusions déposées le 5 février 2005 ;
Mais attendu que l'arrêt relève que bien que M. X..., appelant, ait été avisé de la fixation du calendrier de procédure dès le 31 octobre 2002, il n'avait signifié ses uniques conclusions que le 5 février 2003, soit la veille de l'ordonnance de clôture, empêchant ainsi l'intimé d'y répondre ; qu'ayant ainsi caractérisé l'atteinte portée à la loyauté des débats par les conclusions qu'elle a écartées, la cour d'appel a légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du six octobre deux mille cinq.
