Interruption of Appeal Proceedings Due to Judicial Liquidation
Synthèse Legislator
Généré par l'IAThe Court acknowledged a filing requesting the finding of an interruption of proceedings concerning an appeal brought against a judgment from the Paris Court of Appeal, noting that the appellant had subsequently been placed into judicial liquidation in June 2002, with a liquidator appointed. Applying articles 369 and 376 of the New Code of Civil Procedure, the Court formally noted the interruption of the instance and granted the liquidator a four-month period from the date of the decision to resume the proceedings, warning that failure to do so would result in the declaration of forfeiture of the appeal, while reserving the costs.
