Liquidation of Separation of Property After Divorce and Occupation Indemnity Reduction
Synthèse Legislator
Généré par l'IAIn a dispute arising from the liquidation of a separation of property regime following a divorce, the former husband appealed a decision that granted the former wife preferential allocation of the jointly owned apartment and calculated her occupation indemnity, due after the divorce decree became final, with a 20% reduction because their son continued to occupy the apartment with her until late 2001. The Court of Cassation rejected the appeal, reasoning that since the prior divorce judgment did not factor the former wife's free occupancy into the child support calculation, the subsequent occupation of the apartment by the child with the mother could validly be considered a form of contribution by the father toward the child's upkeep, justifying the reduction of the occupation indemnity owed by the former wife.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu que M. X... fait grief à l'arrêt attaqué (Paris, 19 novembre 2002), statuant sur les difficultés nées de la liquidation du régime de séparation de biens à la suite de son divorce avec Mme Y..., d'avoir retenu, dans le calcul de l'indemnité d'occupation mise à la charge de celle-ci à compter de la date à laquelle la décision de divorce est devenue définitive, un abattement de 20 % en raison de l'occupation de l'appartement indivis par leur fils jusqu'en octobre 2001 et d'avoir, en conséquence, attribué préférentiellement le bien à son ex-épouse ;
Attendu qu'après avoir retenu que, dans son précédent arrêt ayant prononcé le divorce, les contributions dues par M. X... pour l'entretien et l'éducation de ses deux enfants n'avaient pas été fixées en fonction d'une jouissance gratuite de l'appartement par Mme Y... après le divorce, la cour d'appel, qui n'avait pu être saisie auparavant de la question de l'indemnité d'occupation, a pu estimer que l'occupation de l'appartement par l'un des enfants avec sa mère procédait également d'une contribution de son père à son entretien, de nature à réduire le montant de l'indemnité due ; que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne M. X... à payer à Mme Y... la somme de 2 000 euros ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-cinq octobre deux mille cinq.
