Lottery Ticket Forgery and Standing to Sue Appeal
Synthèse Legislator
Généré par l'IAIn a dispute over the payment of a winning lottery ticket, the plaintiff sued to have a vendor-provided "weekly sheet" detailing the ticket declared a forgery, following prior litigation with the lottery operator regarding the ticket itself. The appellate court confirmed the initial judgment in favor of the plaintiff, and the defendant appealed, arguing the lower court erred in confirming the judgment. The Supreme Court dismissed the appeal because the defendant failed to argue in the lower court that the plaintiff lacked standing or interest to sue, rendering the argument raised on appeal new and therefore inadmissible as a mixture of fact and law.

LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, tel que reproduit en annexe :
Attendu, selon l'arrêt attaqué (Versailles, 23 janvier 2003), qu'à la suite de diverses instances ayant opposé M. X... à la société Française des jeux (la société) pour le paiement d'un billet portant le numéro gagnant sur le volet en possession du joueur, ce dernier a assigné la société afin de voir déclarer faux le document intitulé "fiche hebdomadaire" établi par le vendeur détaillant ; que le Tribunal ayant accueilli la demande, la société a relevé appel ;
Attendu que la société fait grief à l'arrêt d'avoir confirmé le jugement ;
Mais attendu qu'il ne résulte ni de l'arrêt ni des productions que la société avait soutenu que la demande était irrecevable pour défaut d'intérêt à agir du demandeur ; que le moyen est donc nouveau et, mélangé de fait et de droit, irrecevable ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société La Francaise des jeux aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du quatorze avril deux mille cinq.
