Lease Termination Clause Interpretation Upheld
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal concerning a lease termination clause, where the lower court had interpreted its prior ruling to mean that lease termination would be avoided if the breach triggering the resolutory clause ceased within the allotted time period. The Supreme Court found the appeal unfounded, thereby upholding the interpretation that the cessation of the infraction during the prescribed period prevented the termination of the lease agreement.

Sur le moyen unique, ci-après annexé :
Attendu que la cour d'appel a, sans modifier sa décision, interprété son précédent arrêt du 27 mars 2002, comme décidant qu'il n'y aurait pas résiliation du bail consenti aux époux X... si l'infraction ayant conduit à l'application de la clause résolutoire cessait pendant le délai accordé ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme Y... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne Mme Y... à payer aux époux X... la somme de 1 900 euros ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de Mme Y... ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par M. Peyrat, conformément à l'article 452 du nouveau Code de procédure civile, à l'audience publique du onze janvier deux mille cinq.
