Appeal Inadmissibility Regarding Suspension of Judgment Pending Administrative Ruling on Domain Nature
Synthèse Legislator
Généré par l'IAA party appealed a final judgment from a court of appeals that suspended its decision concerning the renewal of a commercial lease and beach occupancy rights pending a ruling from the administrative tribunal on the public or private nature of the occupied domain. The highest court declared the appeal inadmissible because the suspension of judgment was an exercise of the judge's discretionary power for the proper administration of justice, not an appealable violation of a rule of law, as only violations of law can be grounds for appealing a decision to suspend judgment rendered at a final instance.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur la recevabilité du pourvoi contestée par la défense :
Vu l'article 380-1 du nouveau Code de procédure civile ;
Attendu que la décision de sursis à statuer rendue en dernier ressort ne peut être attaquée par la voie du pourvoi en cassation que pour violation de la règle de droit ;
Attendu que la société César a formé un pourvoi contre un arrêt rendu par la cour d'appel d'Aix-en-Provence le 15 mai 2003 qui, dans l'instance engagée à l'encontre de la commune d'Antibes en renouvellement d'une convention conférant à cette société la jouissance de locaux commerciaux et d'une portion de plage, a sursis à statuer dans l'attente de la décision du tribunal administratif de Nice devant se prononcer sur la nature publique ou privée du domaine occupé par la société César ;
Attendu que le sursis ayant été prononcé, non pas en application d'une règle de droit, mais dans l'exercice du pouvoir discrétionnaire du juge en vue d'une bonne administration de la justice, le pourvoi n'est pas recevable ;
PAR CES MOTIFS :
DECLARE IRRECEVABLE le pourvoi ;
Condamne la société César aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne la société César à payer à la commune d'Antibes la somme de 2 000 euros ;
Condamne la société César à une amende civile de 2 000 euros envers le Trésor public ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du huit février deux mille cinq.
