Flawed Notification Renders Appeal Invalid
Synthèse Legislator
Généré par l'IAThe appellant sought to appeal a decision from the execution judge concerning over-indebtedness by filing a written appeal via registered mail with acknowledgment of receipt, addressed to the registry of the court that issued the original decision, rather than the registry of the Court of Cassation as required for appeals in such matters. The Court of Cassation determined that because the notification of the judgment incorrectly detailed the appeal procedure, including the deadline and methods, this flawed notification rendered the appeal invalidly lodged, leading the Court to declare that there was no need to rule on the merits of the case.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que Mme X... s'est pourvue en cassation contre un jugement rendu le 20 mai 2003 par un juge de l'exécution, statuant en matière de surendettement, suivant déclaration écrite adressée le 12 juin 2003 par lettre recommandée avec demande d'avis de réception au greffe de la juridiction ayant rendu la décision attaquée ;
Attendu qu'en cette matière, le pourvoi en cassation est formé par déclaration écrite que la partie ou tout mandataire muni d'un pouvoir spécial remet ou adresse par lettre recommandée avec demande d'avis de réception au greffe de la Cour de Cassation ;
Attendu cependant qu'il résulte du dossier de la procédure que l'acte de notification du jugement précisant la voie de recours ouverte, son délai et ses modalités, comportait des mentions erronées ;
que compte tenu de cette notification dépourvue d'efficacité, la Cour de Cassation n'a pas été saisie ;
PAR CES MOTIFS :
DIT n'y avoir lieu à statuer ;
Laisse les dépens à la charge du Trésor public ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du huit juillet deux mille quatre.
