Improper Filing of Appeal in Over-Indebtedness Case
Synthèse Legislator
Généré par l'IAThe applicants sought to appeal a judgment concerning over-indebtedness by filing a written appeal with the registry of the court that issued the decision, contrary to the specific rule requiring that an appeal in such matters be filed by written declaration submitted or sent by registered mail with acknowledgment of receipt directly to the registry of the Court of Cassation. Because the notification of the contested judgment incorrectly informed the parties that an appeal could be filed by oral or written declaration submitted or sent by registered mail to the registry of the lower court, the Court of Cassation ruled that it had not been duly seized of the matter and therefore decided there was no occasion to rule on the appeal.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que M. et Mme X... se sont pourvus en cassation contre un jugement rendu le 2 décembre 2002 par un juge de l'exécution, statuant en matière de surendettement, par déclaration écrite adressée au greffe de la juridiction ayant rendu la décision attaquée ;
Attendu qu'en cette matière, le pourvoi en cassation est formé par déclaration écrite que la partie ou tout mandataire muni d'un pouvoir spécial remet ou adresse par lettre recommandée avec demande d'avis de réception au greffe de la Cour de Cassation ;
Attendu, cependant, qu'il résulte du dossier de la procédure que l'acte de notification du jugement attaqué mentionnait par erreur qu'un pourvoi en cassation pouvait être formé par déclaration orale ou écrite faite, remise ou adressée par pli recommandé au greffe du tribunal d'instance ;
Que compte tenu de cette notification dépourvue d'efficacité, la Cour de Cassation n'a pas été saisie ;
PAR CES MOTIFS :
DIT n'y avoir lieu à statuer ;
Laisse les dépens à la charge du Trésor public ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du huit juillet deux mille quatre.
