Employer Commission Arrears and Employee Termination Appeal Rejection
Synthèse Legislator
Généré par l'IAThe Supreme Court rejected both the main appeal by an employer contesting a judgment ordering payment of commission arrears and the incidental appeal by an employee challenging the dismissal of claims related to termination. The court found that the appellate court had sufficiently addressed the grounds raised in both appeals: for the employer, the appellate court had responded to the arguments regarding commissions, and for the employee, the appellate court had conducted the necessary factual inquiry concerning the nature of a bonus as an established practice before rejecting the termination-related claims.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, CHAMBRE SOCIALE, a rendu l'arrêt suivant :
Sur le moyen unique du pourvoi principal annexé au présent arrêt :
Attendu que l'employeur, pour les motifs énoncés au moyen, fait grief à l'arrêt confirmatif attaqué (Paris, 30 avril 2002) de l'avoir condamné à payer un rappel sur commissions ;
Mais attendu que, contrairement aux énonciations du moyen, la cour d'appel a répondu aux conclusions prétendument délaissées ; que le moyen n'est pas fondé ;
Sur le moyen unique du pourvoi incident annexé au présent arrêt :
Attendu que la salariée, pour les motifs énoncés au moyen, fait grief à cet arrêt d'avoir rejeté ses demandes liées à la rupture ;
Mais attendu que la cour d'appel, qui a constaté que la prime résultait d'un usage et qui s'est livrée à la recherche prétendument omise, n'encourt pas les griefs du moyen ;
PAR CES MOTIFS :
REJETTE les pourvois principal et incident ;
Laisse à chaque partie la charge de ses propres dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette les demandes ;
Ainsi fait et jugé par la Cour de Cassation, Chambre sociale, et prononcé par le président en son audience publique du trente novembre deux mille quatre.
