Spousal Allowance Award Upheld Despite Lack of Explicit Declaration Certification
Synthèse Legislator
Généré par l'IAThe appellant challenged an appellate court's decision awarding the former spouse a compensatory allowance of 800,000 francs, arguing that the evidence of the wife's resources and living conditions was invalid because it lacked the mandatory sworn declaration certifying its accuracy, thus violating the Civil Code. The Supreme Court rejected this appeal, holding that the appellate court was not required to specifically mention in its ruling whether or not the sworn declaration had been produced, as the mere absence of such a specific mention did not invalidate the award.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu que M. X... fait grief à l'arrêt attaqué (Lyon, 4 juin 2002) d'avoir alloué à l'épouse une prestation compensatoire sous la forme d'un capital de 800 000 francs, alors, selon le moyen, qu'en ayant statué au vu d'éléments de preuve des ressources et conditions de vie de l'épouse non assortis d'une déclaration certifiant sur l'honneur l'exactitude de ses ressources et conditions de vie, la cour d'appel a violé l'article 271, alinéa 2, du Code civil ;
Mais attendu que la cour d'appel n'avait pas à faire spécialement mention, dans son arrêt, de ce que la déclaration sur l'honneur avait été ou non produite ; que le moyen ne peut être accueilli ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
