Appellant v. Respondent Regarding Deferred Salary Claim and Will Interpretation
Synthèse Legislator
Généré par l'IAAn appellant challenged a lower court's decision which found she failed to establish the conditions for a deferred salary claim, arguing the court improperly assessed the evidence related to her late mother's will, under which she was the universal legatee. The Court of Cassation rejected the appeal, holding that since the appellant's appeal brief only referenced the will to establish her capacity as a universal legatee, the appellate court was entitled to sovereignly determine that the supporting affidavits provided were too imprecise to substantiate her claim to the deferred salary, rendering the specific challenge to the reasoning on that point irrelevant.

Attendu que Mme Marinette X... fait grief à l'arrêt attaqué (Lyon, 27 septembre 2001) d'avoir dit qu'elle n'établit pas qu'elle remplit les conditions pour prétendre à un salaire différé ;
Mais attendu que les conclusions d'appel de Mme X... ne faisant état du testament de sa mère que pour se prévaloir de sa qualité de légataire universelle, la cour d'appel a estimé souverainement que les attestations produites par la demanderesse étaient trop imprécises pour fonder son droit à salaire différé, abstraction faite du motif surabondant critiqué par la première branche du moyen ; que le moyen ne peut être accueilli ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du trois novembre deux mille quatre.
