Co-Owner Attic Annexation Upheld
Synthèse Legislator
Généré par l'IAThe Supreme Court rejected an appeal by a co-owner who had illegally annexed common area attic space by destroying the separating floor to install insulation, affirming the lower court's decision to order restoration. The court reasoned that the appellant had not previously argued before the appellate court that the attics were private property, rendering that part of the appeal inadmissible as a new mixed issue of fact and law, and further found that the unanimous prior general assembly resolution only permitted use for insulation, not alienation, meaning the unauthorized annexation justified the syndicate's request for the premises to be returned to their original state.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu, d'une part, qu'il ne résulte ni de l'arrêt ni des conclusions que Mme Le X... ait soutenu devant la cour d'appel que les combles constituaient des parties privatives ; que le moyen est nouveau, mélangé de fait et de droit ;
Attendu, d'autre part, qu'ayant relevé qu'en détruisant le plancher haut séparant son appartement des combles, Mme Le X... avait annexé ces parties communes, qu'en termes clairs la résolution de l'assemblée générale du 8 mars 1993, adoptée à l'unanimité des présents, avait autorisé l'utilisation de ceux-ci, pour la pose d'une isolation mais non leur aliénation et que l'impossibilité invoquée par cette copropriétaire de réaliser les travaux sans destruction de ces combles, était un élément de fait qui, s'il était avéré, aurait dû interdire en l'état l'exécution des travaux, la cour d'appel, qui n'était pas tenue de répondre à des conclusions que ses constatations rendaient inopérantes et qui n'a pas statué par des motifs hypothétiques, a pu en déduire que la demande du syndicat de remise des lieux en état devait être accueillie ;
D'où il suit que le moyen, pour partie irrecevable, n'est pas fondé pour le surplus ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme Le X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du quatorze décembre deux mille quatre.
