AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que, par acte déposé au greffe de la Cour de Cassation le 18 octobre 2004, la SCP Piwnica et Molinié, avocat à cette cour, a déclaré au nom de M. X... se désister purement et simplement du pourvoi formé par lui contre une décision rendue par la cour d'appel de Paris le 19 février 2003, au profit des sociétés Librairie Artheme Fayard et Ernest Flammarion, de M. Y... et des consorts Z... ;
Mais attendu que ce désistement est intervenu après le dépôt du rapport ; que dès lors, aux termes de l'article 1026 du nouveau Code de procédure civile, le désistement doit être constaté par arrêt ;
PAR CES MOTIFS :
DONNE acte à M. X... de son désistement de pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du trente novembre deux mille quatre.
