Applicant v. Court of Appeal of Orléans (Judicial Expert Registration)
Synthèse Legislator
Généré par l'IAAn applicant seeking registration as a judicial expert, specifically a Serbo-Croatian and Albanian translator-interpreter, on the annual list of the Court of Appeal of Orléans was refused registration by the general assembly of magistrates. The applicant contested this refusal, arguing that the notification lacked motivation and that a significant need existed for interpreters in those languages within the jurisdiction. The Court of Cassation rejected the appeal, reasoning that the decision of the general assembly regarding expert registration is not subject to the requirement of administrative motivation under the law of July 11, 1979, as it imposes no sanction or denies a vested right, and furthermore, the assessment of the candidate's professional qualities and the necessity of adding a technician to the list falls outside the scope of the Court of Cassation's review.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que M. X... a demandé à être inscrit sur la liste annuelle des experts judiciaires de la cour d'appel d'Orléans, en application des dispositions du décret du 31 décembre 1974, en qualité de traducteur-interprète en langue serbo-croate et en langue albanaise ;
que par décision de l'assemblée générale des magistrats de cette cour d'appel en date du 5 novembre 2003, il n'a pas été inscrit ; qu'il a formé le recours prévu à l'article 34 du décret précité ;
Attendu que M. X... expose que la lettre de notification du refus ne lui donne aucun élément sur la motivation du rejet, qu'il existe un besoin important en Indre et Loire lié à la présence d'une forte communauté ex-yougoslave et albanaise, qu'il est quotidiennement sollicité par différents organismes pour effectuer des missions d'interprétariat et qu'il n'existe qu'un seul interprète assermenté en serbo-croate et aucun en langue albanaise ;
Mais attendu que l'assemblée générale des magistrats de la cour d'appel, statuant sur l'inscription d'un expert, ninflige aucune sanction, ne refuse ni ne restreint un avantage dont l'attribution constituerait un droit et ne prend aucune décision entrant dans l'un des cas prévus par la loi du 11 juillet 1979 relative à la motivation des actes administratifs ; que l'assemblée générale de la cour d'appel était en droit de ne pas motiver sa décision ;
Et attendu que l'appréciation tant des qualités professionnelles du candidat à l'inscription sur la liste des experts judiciaires, que de l'opportunité d'inscrire un technicien sur cette liste eu égard aux besoins des juridictions du ressort de la cour d'appel échappe au contrôle de la Cour de Cassation ;
D'où il suit que le recours n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le recours ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du sept octobre deux mille quatre.
