Employment Association v. Appellant on Judgment Formality
Synthèse Legislator
Généré par l'IAAn appellant challenged a decision ordering him to pay a sum to an employment association, arguing the appellate judgment was void because it failed to explicitly name the clerk who assisted in its pronouncement, thereby violating procedural code articles concerning judgment formality. The highest court rejected this claim, reasoning that the judgment’s inclusion of the name of the clerk present at the hearings, coupled with the fact that the president signed the decision alongside a clerk, created a sufficient presumption that the clerk present during the debates was the same one who assisted at the pronouncement and signed the final document.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu que M. X... fait grief à l'arrêt attaqué (Lyon, 6 décembre 2000) de l'avoir condamné à payer une certaine somme à l'Association pour l'emploi dans l'industrie et le commerce (ASSEDIC) de la région lyonnaise, alors, selon le moyen, que le jugement, authentifié par le greffier qui a assisté à son prononcé, doit comporter le nom de celui-ci ; qu'en l'espèce, l'arrêt attaqué ne contient pas l'indication du nom du greffier qui l'a signé ; que les articles 454, 456, 457 et 458 du nouveau Code de procédure civile ont dès lors été violés ;
Mais attendu que l'arrêt porte l'indication du nom du greffier présent lors des débats et précise qu'il a été prononcé par le président qui l'a signé avec le greffier ; que ces mentions emportent présomption que le greffier présent lors des débats est celui qui a assisté au prononcé de la décision et a signé celle-ci ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du huit juillet deux mille quatre.
