Landlord Liability for Inherent Wear and Tear Despite Full Repair Clause
Synthèse Legislator
Généré par l'IAThe court upheld a decision finding that a landlord, rather than the tenant, was responsible for specific repairs, despite a lease clause shifting all repairs to the tenant. The Court of Cassation reasoned that a clause making the tenant responsible for all repairs is an exceptional clause that must be strictly interpreted and cannot apply to maintenance work necessitated by inherent wear and tear (vétusté); having established that the extensive damage was due to this wear and tear, the appellate court correctly concluded the landlord was liable without misinterpreting the lease contract.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Donne acte à la société civile immobilière du Gue du désistement de son pourvoi en ce qu'il est dirigé contre M. X..., ès qualités ;
Sur le moyen unique :
Attendu qu'ayant relevé, à bon droit, que la clause mettant les réparations, quelles qu'elles soient, à la charge du preneur est une clause exorbitante du droit commun qui doit être interprétée strictement et qu'elle ne peut concerner les travaux d'entretien qu'impose la vétusté et ayant constaté que compte tenu de l'ampleur des dégradations, celles-ci résultaient bien de la vétusté, la cour d'appel en a exactement déduit, sans dénaturer le contrat de bail, que les travaux litigieux incombaient à la bailleresse ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la SCI du Gue aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du sept décembre deux mille quatre.
