Right of Way Agreement Validity Appeal Rejected
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal concerning a private agreement dated April 10, 2002, regarding a right of way, where the appellant contested the agreement's validity based on being in a single copy and alleging an indeterminate obligation. The appellate court had properly determined that the single signed document, corroborated by a subsequent letter confirming the agreement on the right of way's scope, constituted a commencement of written proof, thereby legally justifying the finding that the agreement was valid despite the appellant's arguments regarding the format and certainty of the obligation.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant relevé, par motifs propres et adoptés, que, si l'acte sous seing privé du 10 avril 2002 n'était effectivement rédigé qu'en un seul exemplaire, il était signé par M. X..., et constaté qu'un accord portant sur l'assiette du droit de passage était intervenu, ce que corroborait la lettre adressée le 8 juillet 2002 par M. X... à Mme Y..., la cour d'appel, qui en a déduit que l'acte du 10 avril 2002 valait commencement de preuve par écrit et qui a retenu que M. X... ne pouvait sérieusement soutenir que cet accord n'était pas valable comme portant sur une obligation indéterminée, a, par ces seuls motifs, légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Vu l'article 700 du nouveau code de procédure civile, rejette la demande de Mme Y... ;
Ainsi fait et jugé par la Cour de cassation, troisième chambre civile, et prononcé par le président en son audience publique du vingt février deux mille sept.
