Right of Way by Destination of Original Owner Upheld
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal concerning a right of way, affirming the lower court's decision that a right of way existed over one parcel of land to access another, based on the historical use and layout of the properties which rendered the primary exit insufficient for the intended exploitation of the servient parcel. The appellate court properly determined that the necessity, required under the relevant civil code article for establishing a right of way by destination of the original owner, was met by considering the physical obstacles to access between the various parts of the original property, thereby legally justifying the recognition of the easement.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu qu'ayant souverainement retenu qu'il ressortait de la structure des lieux et de l'usage qui en avait été fait, que pour les besoins de l'exploitation de la parcelle n° 111, l'issue par le surplus de la propriété dont elle faisait partie était insuffisante, et que sa desserte s'était effectuée, depuis des temps très anciens, à travers la parcelle n° 118, la cour d'appel, qui a procédé à la recherche prétendument omise et qui pouvait tenir compte des obstacles à la communication entre les diverses parties d'un même fonds pour l'application de l'article 682 du Code civil, a légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne les époux X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne les époux X... à payer à Mme Y... la somme de 1 900 euros ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande des époux X... ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du seize décembre deux mille trois.
