AU NOM DU PEUPLE FRANCAIS

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :

Attendu que, par acte déposé au greffe de la Cour de Cassation le 22 septembre 2003, la SCP Lyon-Caen, Fabiani et Thiriez, avocat à cette Cour, a déclaré au nom de Mme X... se désister purement et simplement du pourvoi formé par elle contre une décision rendue par la cour d'appel de Lyon, le 14 décembre 2000 au profit de M. Y... ;

Mais attendu que ce désistement est intervenu après le dépôt du rapport ; que dès lors, aux termes de l'article 1026 du nouveau Code de procédure civile, le désistement doit être constaté par arrêt ;

PAR CES MOTIFS :

Donne acte à Mme X... de son désistement de pourvoi ;

Condamne Mme X... aux dépens ;

Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-huit octobre deux mille trois.
