AU NOM DU PEUPLE FRANCAIS

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :

Attendu que, par acte déposé au greffe de la Cour de cassation le 16 janvier 2007, la SCP Peignot et Garreau, avocat à la Cour de cassation, a déclaré, au nom M. Alain X... et Mme Michèle Y..., se désister du pourvoi formé par eux contre un arrêt rendu le 10 novembre 2005 par la cour d'appel de Lyon, au profit de la société Autoroutes Paris-Rhin-Rhône ;

Que ce désistement, intervenu après le dépôt du rapport, doit, aux termes de l'article 1026 du nouveau code de procédure civile, être constaté par arrêt ;

PAR CES MOTIFS :

DONNE ACTE à M. Alain X... et à Mme Michèle Y... du désistement de leur pourvoi ;

Condamne, ensemble, M. Alain X... et Mme Michèle Y... aux dépens ;

Vu l'article 700 du nouveau code de procédure civile, condamne M. Alain X... et Mme Michèle Y..., ensemble, à payer à la société Autoroutes Paris-Rhin-Rhône la somme de 300 euros ;

Ainsi fait et jugé par la Cour de cassation, troisième chambre civile, et prononcé par le président en son audience publique du vingt-huit février deux mille sept.
