Property Classification and Reimbursement in Divorce Liquidation
Synthèse Legislator
Généré par l'IAIn a dispute arising from the liquidation of a community property regime following a divorce, the former spouses disagreed on whether an immovable property located in a specific town was separate or community property, and on the amount of a reimbursement due to the community after community funds were used to finance a house built on the property following the demolition of previous structures. The appellate court ruled that the property constituted separate property belonging to one spouse and fixed the community's reimbursement at a specific amount based on an expert report, having determined that the negligible value of the destroyed prior buildings should be excluded from the reimbursement calculation. The Court of Cassation rejected the appeal, finding that the appellate court had legally justified its decision by properly evaluating the facts and conducting the necessary legal assessment regarding the reimbursement calculation.

Attendu que M. X... et Mme Y... se sont mariés le 3 juin 1957 sous le régime de la communauté réduite aux acquêts ; qu'ils ont divorcé le 26 avril 1992 ; que, lors des opérations de liquidation et de partage de la communauté, ils se sont opposés sur la nature propre ou commune d'un bien immobilier situé à Etampes et sur le montant de la récompense éventuellement due par Mme Y... à la suite du financement par la communauté d'un pavillon édifié sur le fonds après démolition des bâtiments antérieurement implantés ; que Mme Y... fait grief à l'arrêt confirmatif attaqué (Paris, 31 octobre 2000) d'avoir décidé que le bien immobilier constitue un propre lui appartenant et d'avoir, sur la base d'un rapport d'expertise, évalué à 614 000 francs le montant de la récompense ;
Attendu qu'ayant relevé que les bâtiments détruits avaient une valeur négligeable, ce dont il résultait qu'elle ne devait pas être retenue pour la calcul de la récompense, la cour d'appel, qui a procédé à la recherche demandée, a, sans encourir les griefs du moyen, légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme Y... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, rejette les demandes ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-huit octobre deux mille trois.
