Landlord v. Tenant: Security Deposit Dispute Following Lease Termination and Prior Injunction
Synthèse Legislator
Généré par l'IAIn a dispute arising from a commercial lease termination, the former landlord sued the former tenant for the return of the security deposit after a prior injunction confirmed the tenant owed occupation indemnity only up to the date the landlord sold the property (March 3, 1999), and the landlord was ordered to compensate by returning the deposit. The appellate court incorrectly dismissed the landlord's claim for the deposit return, reasoning that the injunction established the tenant had vacated on March 3, 1999, thereby obligating the landlord to refund the deposit. The high court partially quashed the appellate decision, ruling that the lower court violated procedural rules by misinterpreting the scope of the injunction, which merely quantified the occupation indemnity until the sale date and did not definitively settle the underlying right to deposit reimbursement as a consequence of vacating.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Vu l'article 4 du nouveau code de procédure civile ;
Attendu, selon l'arrêt attaqué (Paris, 30 novembre 2005) que la société Scorbel, preneur à bail de locaux à usage commercial, appartenant alors à la société Belletoile, lui a donné congé à effet du 31 octobre 1998 ; que la locataire s'étant maintenue dans les lieux, la société Belletoile l'a assignée en référé pour la voir condamnée à payer une indemnité d'occupation ; que le 3 mars 1999, la société Belletoile a vendu les locaux ; que, par ordonnance de référé du 17 juin 1999, la société Scorbel a été condamnée à régler une indemnité d'occupation pour la période courant de la date d'effet du congé à celle de la cession, et la société Belletoile à restituer par compensation le dépôt de garantie ;
que la société Belletoile a assigné la société Scorbel devant le juge du fond en répétition des sommes versées au titre du dépôt de garantie ;
Attendu que pour rejeter cette demande, l'arrêt retient qu'il résulte des motifs de l'ordonnance rendue en matière de référé le 17 juin 1999 que le départ des lieux de la société Scorbel se situe au 3 mars 1999 et qu'en conséquence de ce départ la société Belletoile était bien redevable du remboursement de ce dépôt de garantie ;
Qu'en statuant ainsi, alors que l'ordonnance de référé se bornait à constater que la société Scorbel devait régler à la société Belletoile une indemnité d'occupation pour la période courant de la date d'effet du congé jusqu'au 3 mars 1999, date de la cession des locaux par la société Belletoile, la cour d'appel a violé le texte susvisé ;
PAR CES MOTIFS :
CASSE ET ANNULE, mais seulement en ce qu'il a débouté la société Belletoile de sa demande à l'encontre de la société Scorbel, l'arrêt rendu le 30 novembre 2005, entre les parties, par la cour d'appel de Paris ; remet, en conséquence, sur ce point, la cause et les parties dans l'état où elles se trouvaient avant ledit arrêt et, pour être fait droit, les renvoie devant la cour d'appel de Paris, autrement composée ;
Condamne la société Scorbel aux dépens ;
Vu l'article 700 du nouveau code de procédure civile, condamne la société Scorbel à payer à la société Belletoile la somme de 1 800 euros ;
Dit que sur les diligences du procureur général près la Cour de cassation, le présent arrêt sera transmis pour être transcrit en marge ou à la suite de l'arrêt partiellement cassé ;
Ainsi fait et jugé par la Cour de cassation, troisième chambre civile, et prononcé par le président en son audience publique du six février deux mille sept.
