Lender's Action Timeliness Based on Payment Imputation Rule
Synthèse Legislator
Généré par l'IAThe appellant contested the lower court's decision, which determined the date of the first unrectified payment default to be March 23, 1999, leading to the finding that the lender's action, commenced over two years later, was time-barred, by asserting a violation of the supplementary rule for imputation of payments under Article 1254 of the Civil Code. The court dismissed the appeal, reasoning that the single piece of evidence provided by the appellant was insufficient to demonstrate a misapplication of the imputation rule, as the lower court had made a sovereign assessment based on comprehensive documentation, including the loan history, amortization schedule at the time of term default, and a certified detail of the debt.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, tel qu'il figure au mémoire en demande et est reproduit en annexe au présent arrêt :
Attendu que la seule pièce produite à l'appui du pourvoi, qui n'est pas arguée de dénaturation, ne suffit pas à caractériser la prétendue violation par le juge du fond (tribunal d'instance de Fort-de-France, 27 août 2001) de la règle d'imputation des paiements supplétive de la volonté des parties, édictée par l'article 1254 du Code civil, dès lors qu'au nombre des pièces jointes à l'assignation figuraient notamment, outre l'historique du prêt, le tableau d'amortissement au jour de la déchéance du terme et le détail de la créance certifié conforme, dont les énonciations ont conduit le Tribunal, par une appréciation souveraine, à fixer au 23 mars 1999 la date du premier incident non régularisé pour retenir la forclusion de l'action du prêteur, engagée plus de deux ans après cette date ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société Casden banque populaire aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-quatre février deux mille quatre.
