Dispute Over Parental Donation-Sharing Agreement, Penalty Clause, and Indemnity for Exclusive Occupation of Indivised Property
Synthèse Legislator
Généré par l'IAThe dispute arose after the death of two parents who had previously executed a donation-sharing agreement in 1981 that included a penalty clause for contesting the division and an agreement on indivision among their seven children. One child appealed a decision that refused to apply the penalty clause to the other siblings, arguing that the division and indivision agreement were indivisible parts of the single act; the court rejected this, finding that the plaintiffs were justified in seeking the division of all assets because one sibling had renounced the benefit of the indivision agreement, meaning the action did not constitute an "attack" on the original act. Additionally, the court upheld the lower court's finding that the same sibling was liable for an occupation indemnity to the indivision estate for the private use of an indivised property after the second parent's death, regardless of the stated purpose of maintaining the property, because the exclusive occupation of an indivised asset automatically triggers the right to an indemnity absent a contrary agreement.

AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que les époux Pierre X... sont décédés respectivement les 22 juillet 1987 et 6 août 1997, en laissant pour leur succéder leurs sept enfants, après leur avoir consenti, le 21 octobre 1981, une donation-partage, l'acte contenant en outre une clause sanctionnant le donataire qui attaquerait le partage, ainsi qu'une convention d'indivision ;
Sur le premier moyen, qui n'est pas nouveau :
Attendu que l'un des enfants, Mme Marie-Christine X..., fait grief à l'arrêt confirmatif attaqué (Angers, 10 janvier 2001) d'avoir refusé d'appliquer aux consorts X... la sanction prévue à l'acte du 21 octobre 1981, alors, selon le moyen, qu'en s'abstenant de rechercher si, contenus dans un seul et même acte, le partage et la convention d'indivision n'étaient pas indivisiblement liés, de sorte que la sanction stipulée devait s'appliquer à toute personne attaquant tout ou partie de cet acte, la cour d'appel a méconnu l'article 1134 du Code civil ;
Mais attendu qu'ayant relevé que Mme Marie-Christine X... avait renoncé au bénéfice de la convention d'indivision, la cour d'appel a exactement décidé, par motifs propres et adoptés, que l'assignation délivrée par les consorts X... et tendant à voir ordonner le partage de tous les biens dépendant des successions, y compris ceux concernés par l'acte du 21 octobre 1981, était justifiée et que ses auteurs n'avaient pas "attaqué" cet acte ; que le moyen est donc inopérant ;
Sur le second moyen :
Attendu que Mme Marie-Christine X... fait encore grief à l'arrêt attaqué d'avoir dit qu'elle était débitrice à compter du 6 août 1997 envers l'indivision d'une indemnité pour l'occupation d'un immeuble indivis, alors, selon le moyen, que la cour d'appel, qui n'a pas constaté qu'elle aurait fait obstacle à l'accès des autres indivisaires à la maison en cause, cependant qu'elle faisait valoir occuper la maison en vue de son entretien pour le compte commun, tous ses frères y ayant accès, n'a pas donné de base légale à sa décision au regard de l'article 815-9 du Code civil ;
Mais attendu qu'ayant relevé que Mme Marie-Christine X... occupait privativement un immeuble indivis, la cour d'appel a encore exactement décidé que le droit à l'indemnité d'occupation en était la conséquence, faute de convention contraire et quel que soit le but de cette occupation ; qu'elle a ainsi légalement justifié sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne Mme Marie-Christine X... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne Mme Marie-Christine X... à payer aux consorts X... la somme de 2 286,74 euros ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-cinq novembre deux mille trois.
