Patrimonial Devolution Agreement Dispute Over Apartment and Pharmacy Partition
Synthèse Legislator
Généré par l'IAThe case concerns a dispute over the division of assets, specifically an apartment and a pharmacy, following a patrimonial devolution agreement between parents and their children in 1984, where one son received the pharmacy in exchange for ceding most of his share in the apartment and a future payment related to the sale of another property. The Court of Appeal upheld the lower court's finding that the initial payment for the pharmacy was insufficient to confirm an agreement for the sale of the indivis share in the apartment, as that sale was conditional upon the realization of the other property sale, which had not occurred. Therefore, the appellate court correctly determined that opening the proceedings for accounting, liquidation, and partition among the co-owners was justified, leading the highest court to reject the appeal.

partage entre les coindivisaires était justifiée ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. Jean-Louis Y... aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne M. Jean-Louis Y... à payer à M. Jean-Michel Y... la somme de 1900 euros ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de M. Jean-Louis Y... ;
