AU NOM DU PEUPLE FRANCAIS
LA COUR DE CASSATION, DEUXIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Attendu que la Banque San Paolo, condamnée aux dépens par arrêt du 7 juin 2001 dans une instance l'opposant notamment à la Banque régionale de l'Ouest (BRO), fait grief à l'ordonnance attaquée, rendue par le premier président d'une cour d'appel, statuant en matière de taxe (Orléans, 21 mars 2002), d'avoir fixé à une certaine somme les frais et émoluments de la SCP Duthoit-Desplanques, avoué de la BRO ;
Mais attendu que l'arrêt du 7 juin 2001 a été cassé par arrêt de la Chambre commerciale de la Cour de Cassation du 13 mai 2003 ;
D'où il suit qu'en application de l'article 625 du nouveau Code de procédure civile, l'ordonnance attaquée par le présent pourvoi se trouve annulée par voie de conséquence ;
PAR CES MOTIFS :
DIT n'y avoir lieu à statuer ;
Condamne la Banque San Paolo aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Deuxième chambre civile, et prononcé par le président en son audience publique du premier avril deux mille quatre.
