Resident v. Postal Service Mail Delivery Dispute
Synthèse Legislator
Généré par l'IAA resident, whose home was located off a rural road accessible via a gravel path and then a dirt service road, had a verbal agreement with the postal service where mail was delivered to an intersection of these roads, with the resident being alerted by a vehicle horn or receiving a delivery notice in a mailbox at the rural road entrance; however, after the resident removed this mailbox, the postal service ceased delivery at that point, leading the resident to sue for mandatory delivery and damages. The court rejected the appeal, reasoning that the continuing agreement was subject to unilateral termination by either party, and since the prior arrangement had become problematic due to access difficulties causing significant delays for the mail carrier following the removal of the mailbox, the appellate court was justified in finding no fault with the postal service for discontinuing the arrangement.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique :
Attendu qu'en 1989, M. X..., qui habite une caravane située sur un terrain accessible par un chemin rural empierré puis un chemin d'exploitation en nature de terre a conclu avec La Poste une convention verbale, aux termes de laquelle les plis recommandés étaient acheminés par le facteur jusqu'à l'embranchement formé entre le chemin rural et le chemin d'exploitation, M. X... était averti de la présence du facteur au moyen de l'avertisseur sonore de son véhicule, et dans le cas où celui-ci ne se manifestait pas, le facteur déposait un avis de passage dans la boîte aux lettres située à l'entrée du chemin rural ; qu'en 1997, M. X... a retiré la boîte aux lettres et La Poste a cessé d'acheminer les colis et lettres recommandés jusqu'à cet embranchement ; que M. X... a assigné La Poste pour obtenir sa condamnation à lui distribuer son courrier, sous astreinte, et à lui payer des dommages-intérêts ;
Attendu que M. X... fait grief à l'arrêt attaqué (Colmar, 12 juillet 2000) de l'avoir débouté de sa demande tendant à ce que La Poste lui distribue à son domicile les plis et objets recommandés, alors, selon le moyen, qu'il ressort des propres constatations de l'arrêt attaqué que la Poste s'était engagée, par convention, à acheminer les colis et lettres recommandés adressés à M. X... "jusqu'à l'embranchement formé entre le chemin rural et le chemin d'exploitation" à moins de 100 mètres du domicile de M. X... ; qu'en dispensant La Poste de cette obligation, motif pris de difficultés d'accès ordinaires, sans caractériser la force majeure ou l'impossibilité absolue pour La Poste d'accéder jusqu'au point convenu, la cour d'appel a privé sa décision de base légale au regard de l'article 1134 du Code civil ;
Mais attendu que la convention à exécution successive conclue par les parties ne prévoyant aucun terme, chacune d'elles avait la faculté de la résilier unilatéralement, sauf abus sanctionné par l'article 1134, alinéa 3, du Code civil ; qu'ayant constaté que La Poste avait satisfait à ses obligations jusqu'à ce que M. X... retire la boîte aux lettres située à l'entrée du chemin rural, que la mise en oeuvre de l'arrangement convenu s'était soldée par un échec compte tenu des difficultés d'accès à l'habitation de M. X... et avait entraîné un allongement sensible du parcours du facteur nuisant à la bonne exécution du service, la cour d'appel a pu en déduire qu'aucune faute ne pouvait être reprochée à La Poste, justifiant ainsi légalement sa décision ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du vingt-sept avril deux mille quatre.
