Owner Appeal on Contract Termination Formalities Dismissed
Synthèse Legislator
Généré par l'IAThe owner of a construction project appealed a decision concerning the termination of a contract with an entrepreneur, arguing that the lower court erred in finding that the termination formalities were not met. The Court of Cassation rejected the appeal, affirming that the appellate court was justified, based on its sovereign evaluation of the facts, in concluding that the owner failed to comply with the formal requirements of Article 10-1-3 of the specific administrative conditions by not formally demanding the contractor remedy its breaches before terminating the contract, regardless of whether delays in the work existed, as the lower court's decision only addressed the existence of delays, not the content of the project manager's correspondence regarding them.

LA COUR DE CASSATION, TROISIEME CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, ci-après annexé :
Attendu que c'est souverainement que la cour d'appel a retenu que la SCCV La Maine, maitre de l'ouvrage, n'ayant pas mis en demeure avant résiliation la société Pananceau, entrepreneur, de tenir ses engagements, n'avait pas respecté les conditions de forme stipulées par l'article 10-1-3 du cahier des clauses administratives particulières (CCAP), l'arrêt ne contenant aucune motivation relative au contenu des correspondances émanant du maître d'oeuvre au sujet des retard de travaux, mais seulement à leur existence, non contestée ;
D'où il suit que le moyen n'est pas fondé ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne la société SCCV La Maine aux dépens ;
Vu l'article 700 du nouveau Code de procédure civile, condamne la société SCCV La Maine à payer la somme de 1 900 euros à la société Pananceau et à M. X..., ès qualités, ensemble ;
Vu l'article 700 du nouveau Code de procédure civile, rejette la demande de la société La Maine ;
Ainsi fait et jugé par la Cour de Cassation, Troisième chambre civile, et prononcé par le président en son audience publique du seize mars deux mille quatre.
