Estate Management Remuneration Dispute
Synthèse Legislator
Généré par l'IAThe Court of Cassation rejected an appeal against a decision that awarded an individual an annual remuneration for managing an undivided agricultural operation belonging to his parents' estate between 1987 and 1993, after their passing, specifically as compensation for management services rather than a deferred salary. The appellate court reasoned that the appellant's argument invoking an inapplicable article of the Rural Code, which governs deferred salary, lacked legal basis because the awarded sum was explicitly not characterized as such, rendering the related ground for appeal inoperative.

LA COUR DE CASSATION, PREMIERE CHAMBRE CIVILE, a rendu l'arrêt suivant :
Sur le moyen unique, pris en ses deux branches, tel qu'il est énoncé dans le mémoire en demande et reproduit en annexe :
Attendu que l'arrêt attaqué (Agen, 27 janvier 2000) a alloué à M. Serge X... une rémunération de 3 000 francs par an pour la gestion de l'exploitation agricole indivise dépendant de la succession de ses parents, qu'il a assurée de 1987 à 1993, postérieurement à leur décès, et non au titre d'un salaire différé ; d'où il suit que le moyen tiré d'un manque de base légale au regard de l'article L. 321-13, alinéa 2, du Code rural, inapplicable en l'espèce, est inopérant ;
PAR CES MOTIFS :
REJETTE le pourvoi ;
Condamne M. X... aux dépens ;
Vu les articles 700 du nouveau Code de procédure civile, 37, alinéa 2, et 75 de la loi du 10 juillet 1991, rejette la demande de la SCP Lyon-Caen, Fabiani et Thiriez ;
Ainsi fait et jugé par la Cour de Cassation, Première chambre civile, et prononcé par le président en son audience publique du huit juin deux mille quatre.
